Limitation of Liability
Effective date: 27 October 2026
1. General Provisions
1.1. This document forms an integral part of the Terms of Service and sets out the limits of liability of IE "DeusCode" (an individual entrepreneur registered in the Republic of Kazakhstan, Almaty; the "Operator") in connection with the use of the DeusCRMLight (DCL) CRM system (the "Service").
1.2. The provisions of this document apply to the fullest extent permitted by applicable law. Unless expressly provided otherwise by mandatory rules of law applicable to the user, the limitations set out below apply. If any provision cannot be applied, the remaining provisions remain in force.
2. Service Provided "As Is"
2.1. The Service is provided "as is" and "as available". The Operator does not warrant that the Service will meet all of the user's expectations or be fit for the user's particular purposes.
2.2. The Operator does not guarantee uninterrupted or error-free operation of the Service. Interruptions may occur due to maintenance or failures of equipment, software, communication networks or third-party services.
2.3. The Operator takes reasonable measures to keep the Service operational and to remedy failures within a reasonable time.
3. Indirect Losses
The Operator is not liable for indirect losses, lost profits, loss of revenue, clients or business opportunities, or damage to business reputation, even if the Operator was aware of the possibility of such losses.
4. User Data and User Actions
4.1. The Operator is not responsible for the content, accuracy or lawfulness of data entered by users and their employees, including any lack of consent of data subjects to its processing.
4.2. The Operator is not responsible for the actions of users and their employees, including the modification and deletion of data by employees within the rights granted to them, or for the consequences of unauthorized access made possible by the user's failure to keep their password or API keys confidential.
4.3. The account owner configures the roles and rights of employees and is responsible for its choices.
5. Third-Party Services
5.1. The operation of the Service depends on third-party services: 1C, IP telephony providers, Telegram, browsers and push notification services, payment providers, hosting and infrastructure providers, and telecommunications operators.
5.2. The Operator is not responsible for the availability, operation, terms or actions of third-party services, or for their failures and changes, unless they are caused by the Operator's fault. The user connects integrations at its own discretion, and the rules of the relevant services apply to them.
6. Data Loss
6.1. The Operator performs backups but is not liable for the loss of or damage to data caused by the user, including deletion or overwriting of data by the user or its employees, import of incorrect files, the operation of integrations connected by the user, loss of access to credentials, or deletion of the account.
6.2. The Operator recommends exporting data regularly using CSV and JSON export.
7. Force Majeure
The Operator is not liable for failure to perform or improper performance of its obligations caused by force majeure, including natural disasters, military action, civil unrest, acts of government authorities, large-scale power and communication outages, data center failures, massive cyberattacks that could not be repelled despite reasonable protective measures, and other circumstances beyond the Operator's reasonable control.
8. Aggregate Liability Cap
The Operator's aggregate liability for all claims relating to the Service is limited to the amount actually paid by the user to the Operator for the Service during the 3 months preceding the event giving rise to the claim.
9. User Liability
The user shall compensate the Operator for losses, including reasonable costs, arising from claims by third parties (including data subjects and government authorities) where such claims result from the user's breach of the Terms of Service or the law, including processing data without the necessary consents.
10. Exceptions
The limitations set out in this document do not apply to liability for intentional breach of obligations, or in cases where limitation of liability is not permitted by the law of the Republic of Kazakhstan or by mandatory rules of law applicable to the user.
11. Claims
Claims must be sent to info@deuscode.tech. The Operator responds within 10 business days. The further procedure for resolving disputes is set out in the Terms of Service.
